Designer Christopher Psaila (the same man Erika once accused of running up $800,000 in fraudulent AmEx charges) and his business partner Marco Morante had sued Wilkes, claiming the lawyer blatantly lied on PPP applications – inflating his staff numbers by 40 employees – to snag nearly $4.4 million in government relief funds that were ultimately forgiven.

Even spicier? The lawsuit boldly declared that those very taxpayer dollars were used to “pay, invest in, or loan” money to Erika Jayne and her team, and to bankroll the army of lawyers defending her in the infamous Tom Girardi embezzlement scandal.

But on December 1, the judge slammed the brakes on the entire case, calling it a classic example of “shotgun pleading” – legal speak for a sloppy, vague, tabloid-style complaint filled with “conclusory, vague, and immaterial facts” instead of hard evidence. The judge also noted the plaintiffs mysteriously forgot to disclose their own citizenship, a basic requirement to prove the federal court even had jurisdiction.

Case dismissed… for now.
