But in a verdict delivered after weeks of intense hearings, the court sided squarely with Lochan, declaring Whitney’s statements defamatory and driven by malice. The judge highlighted the “devastating impact” on Lochan’s reputation, noting how the accusations had painted him as a racist in the public eye, despite his denials and evidence of a multicultural upbringing. Lochan’s legal team— the same powerhouse firm, Brandsmiths, that secured a £1 million settlement for comedian David Walliams against Britain’s Got Talent producers—presented a compelling case, including witness testimonies and a detailed “particulars of claim” outlining the reputational damage.
