At the sentencing hearing, conducted via Zoom, Busey’s attorney, Blair Zwillman, attempted to downplay the severity of the offense. Citing the actor’s age, health struggles, and residence in California, Zwillman argued probation was unnecessary. Busey’s medical history includes a near-fatal motorcycle accident in 1988 that left him in a coma for 30 days, resulting in severe brain injuries that forced him to relearn basic functions. Zwillman added that Busey now suffers from mild cognitive impairment and early dementia, claiming the incident was less severe than other sexual misconduct cases since it occurred over clothing during a public event.

However, Judge Gwendolyn Blue was unmoved by the defense’s arguments.
